Exemption from Solar Power Levy

The General Financial Directorate (the “GFD”) has released information on the new legislation applicable to exemptions from the levy on solar power, which will take effect as of 1 January 2013. The Supported Energy Resources Act[1] supersedes the Act for Support of Renewable Resources,[2] which we have addressed several times in prior editions of Tax News. Newly exempted from the levy is solar power generated from solar power equipment with an installed output of up to 30 kW. The exemption can only be applied, however, to electricity generated from 1 January 2013 until 31 December 2013. Electricity generated and to be generated by the end of 2012 is subject to the existing rules, whereunder the exemption applies to solar power generated from all solar generation equipment with an installed output of up to 30 kW that are installed on rooftops or walls of a single building attached to the ground through a solid foundation, whereas such building is required to be registered in the land (cadastral) register. Supreme Administrative Court again rules in favour of Czech Radio in VAT dispute

At the beginning of March 2012 the Supreme Administrative Court in Brno satisfied a second cassation complaint lodged by Czech Radio. Claiming non-reviewability, the Supreme Administrative Court once again dismissed the Prague Municipal Court’s judgment whereunder Czech Radio was not allowed to exercise a claim to have VAT deducted on the grounds that it collects broadcasting fees. Czech Radio, represented by Kocián Šolc Balaštík, disagreed with the Municipal Court’s judgement.

Supreme Administrative Court confirms legitimacy of lawsuit filed by WEEE collection system operator against Ministry of Environment

The proceedings concerned the refusal of an application to register REMA Systém, a.s. in the so-called List of manufacturers of electrical devices that are to be in charge of ensuring the financing of the disposal and handling of historical electrical devices within class 3 – IT and telecommunications equipment.

Martina Zímová and Ivo Šimeček published an article on the new block exemption for vertical agreements between undertakings in weekly magazine Ekonom. Pursuant to the applicable Commission Regulation, certain vertical agreements (such as agreements between manufacturers and distributors, franchising agreements, etc.) are permitted subject to their compliance with predefined requirements although each one of them could be considered as illegal and, as such, be banned. On 1 June 2010, the Supreme Administrative Court ruled in Ref. no. 5 Afs 64/2008-156 regarding the right to information on tax exemption or, as the case may be, tax interest and charges,

which occur due to the decision of the Ministry of Finance or the tax office. Entities, which are exempt from tax or tax interest and charges by the state, are in principle recipients of public funds according to the Supreme Administrative Court, and the duty of confidentiality does not apply on information on exemptions within the framework of the tax proceedings.

From Judicature - on 11 June 2009 the European Court of Justice in the case C-572/07, RLRE Telmer Proper Ltd. commented on the interpretation of services of cleaning common areas of rental housing

Pursuant to the ECJ’s interpretation, the cleaning of common areas cannot be included as a part of housing rental services. Supply of rental apartments is exempt from VAT, but services of cleaning common areas must be subject to VAT.

From Judicature - on 5 January 2010 and under Ref. No. 2 Afs 87/2009-131, the Supreme Administrative Court provided its opinion on deadlines determined by a legal “fiction”

In the event that the date for delivery of a tax administrator’s letter is determined by a legal fiction, i.e. for example ten days after the recipient fails to collect the relevant document and has been appropriately notified in advance that the document was deposited, the date of a statutory holiday or Saturday or Sunday shall may also be considered as the date of delivery.

From Judicature - on 15 April 2010, ref. No. 7 Afs 15/2010-89, the Supreme Administrative Court ruled on an appeal by the Financial Directorate of Ústí nad Labem

The ruling will affect assessment of the issue as to whether the commencement of a tax audit, without notification of any doubt or suspicion as to compliance with tax duties interrupts the statutory time period within which tax assessments may be made.

Significant Changes in Public Procurement Law

This major amendment was approved by the House of Representatives on 18 May 2010 subject to the Senate’s proposals for changes. It has been signed by the President of the Czech Republic and is waiting for publication. The amendment contains a set of changes which should increase the transparency of awarding contracts, simplify the current procedures and impose clearer rules on an overall basis for dealing with public funds.
