A Historic Success After Twenty Years: Unlawful State Decision Confirmed

AThe team, consisting of Tomáš Sequens and Petra Mirovská, achieved a significant victory in a complex legal dispute over compensation for damages against the state after a long twenty years of legal battles. The case concerned an unlawful decision and administrative misconduct by the Ministry of the Environment during a licensing procedure conducted in 2005.

The appellate court has definitively ruled that, in 2005, the operator of the REMA collective system should have been selected as the sole financial manager for handling historical electronic equipment in Group 3. This groundbreaking verdict grants the plaintiff, the operator of the collective system, compensation for the loss of a major electronics manufacturer caused by the state’s error and paves the way for further claims. The legal battle, however, is far from over!

Even at this stage, this success stands as proof of our team’s persistence, expertise, and determination, as well as an example of interdisciplinary collaboration and the successful cooperation of litigation specialists with experts in environmental issues and waste management.
