KŠB Wins the Lázně Kyselka Defamation Case

The Association’s representative is to apologize for public statements addressed to KMV’s CEO (whom KŠB represented in the dispute) regarding the condition of buildings in Kyselka. The High Court in Prague (as the appellate court) held that, rather than fair criticism, the statements were grossly insulting and defamatory to Mr. Pasquale. In addition to the apology, the court awarded non-pecuniary damages in the requested amount and ordered the Association to refrain from making further defamatory public statements against Mr. Pasquale. That part of the claim was originally dismissed by the Municipal Court in Prague; however, in response to the claimant’s appeal, the High Court ruled in favour of the claimant and the decision is now enforceable.
