Tomáš Sequens and Dana Jacková Discuss the Risks of the Proposed Amendment to the Building Act
KŠB partner Tomáš Sequens and counsel Dana Jacková recently spoke to specialist news platforms Česká justice and Ekonomický deník about the proposed amendment to the Building Act, which aims to accelerate and simplify the construction permitting process.
In the interview, they highlight the risks associated with abolishing the unified environmental opinion, reorganising the building administration, restricting the scope for reviewing permits and making it easier to legalise unauthorised buildings retrospectively. In their view, some of the proposed changes could weaken environmental protection and lead to litigation in both Czech and European courts.
While Tomáš and Dana do not question the need to speed up construction permitting procedures and curb unjustified obstruction, they believe that priority should be given instead to effective digitalisation, ensuring an adequate number of qualified officials, and conducting a thorough expert discussion on the proposed changes.
