KSB Again Successful in Representing RWE Transgas

Representing RWE Transgas in proceedings at the Regional Court in Brno, KSB was recently successful in getting a CZK 240 million fine nullified for a third time. The fine was originally imposed by the Competition Authority in 2006 for RWE Transgas’s alleged violation of competition on the wholesale gas market.

KSB has been representing RWE Transgas since the appellate proceedings. At that time, the Competition Authority’s Chairman accepted KSB’s argument and reduced the original fine from CZK 370 million to CZK 240 million. In 2007 the Regional Court in Brno nullified the fine entirely. Subsequently, however, the Competition Authority’s Chairman filed two special appeals to the Supreme Administrative Court, thereby returning the matter to the Regional Court in Brno twice. In January 2012, the Regional Court in Brno exonerated RWE Transgas from the fine for the third time.

KŠB achieved a significant victory in one of the most closely watched cases concerning a review of the adequacy of the consideration paid in a squeeze-out of minority shareholders

The Municipal Court in Prague, in the first instance, dismissed the claims of former minority shareholders of PFNonwovens a.s., who challenged the adequacy of the consideration paid during the squeeze-out carried out in March 2021 and sought to have it increased by up to double the amount.
