According to Martin, the law should not serve politics or business, nor should it bury or even threaten fair business. “The law should not cause a fair businessman to ask his lawyer with a trembling voice three times a day whether or not he can do a certain thing or whether what his lawyer says will hold true or not.”
The new Corporations Act is a “call for change”, Martin believes. “However, some of the “not possible” guys still seem to be out there, so I hear bizarre interpretations here and there which entirely ignore business as it is in reality and even how things are interpreted elsewhere outside our Czech backyard.”
“Hence what I wish for us in 2016 is fairly clear: that all interpreters of the law, rather than putting up “grammar”, “doctrine” or “consistency” shields, look at how things are in real life and simply think about why they are that way.”

Letošní rozhodnutí Nejvyššího soudu a Nejvyššího správního soudu navázala na rozsudky Soudního dvora Evropské unie, a, s platností i pro Českou republiku, konstatovala, že zveřejňování údajů v rámci evidence skutečných majitelů představuje nepřiměřený zásah do základních práv majitelů na soukromí a ochranu osobních údajů. Důležitým aspektem těchto rozhodnutí byl závěr, že sankce, které postihují povinné subjekty jako reakce na nesplnění jejich povinnosti zápisu do evidence skutečných majitelů, není možné vymáhat, dokud je evidence veřejná. Tato situace se změní 17. prosince 2025, kdy ministerstvo znepřístupní evidenci skutečných majitelů; povinným subjektům tak budou opět hrozit závažné sankce.
30. Adventní koncert pro Výbor dobré vůle - Nadaci Olgy Havlové
I letos se v čase předvánočním uskutečnil Adventní koncert dobré vůle, který od roku 1995 pořádá advokátní kancelář Kocián Šolc Balaštík ve prospěch Výboru dobré vůle – Nadace Olgy Havlové. Tentokrát šlo již o jubilejní 30. ročník a výjimečný byl i tím, že jsme jej poprvé pořádali společně s naším partnerem, Smetanovou Litomyšlí, v rámci širší vzájemné spolupráce. Koncert se jako vždy konal v koncertní síni kostela sv. Šimona a Judy na Starém Městě v Praze.
30th Advent Concert for the Committee of Good Will – Olga Havlová Foundation
The Advent Concert of Good Will, organised since 1995 by the law firm Kocián Šolc Balaštík for the benefit of the Committee of Good Will – Olga Havlová Foundation, will this year take place on Sunday, 7 December, from 7:00 p.m., traditionally in the concert hall of the Church of Sts. Simon and Jude in the Old Town of Prague. The concert is held under the auspices of the First Lady of the Czech Republic, Mrs Eva Pavlová.
