KŠB advises LEO Express in litigation against České dráhy, a.s. concerning compensation for damage
LEO Express filed an action at the Municipal Court in Prague for compensation for damage against České dráhy for abusing its dominant position in the railway passenger transport market pursuant to the Czech Act on the Protection of Economic Competition and the Treaty on the Functioning of the European Union.
LEO Express, which is represented by a team of KŠB attorneys led by partner Pavel Dejl, quantified the damage in the form of lost profits in the amount of CZK 418 million. According to the plaintiff, České dráhy’s illegal conduct consisted of predatory pricing, i.e. offering very low prices on the Prague – Ostrava route. Pavel Dejl added that “the action is important for the development of a competitive environment in railway passenger transport not only in the Czech Republic but in the European Union as a whole. The goal is to remedy the damage that ČD, as holding a former monopoly, has caused in trying to prevent competitive private carriers such as LEO Express from entering the market and competing without EU subsidies.”
