KŠB Helps Advanced World Transport a.s. Win Administrative Dispute01/03/13 / News

Kocián Šolc Balaštík represented Advanced World Transport a.s. and helped it win a more-than-year-long dispute over the prices for using the Czech railway system.

Advanced World Transport a.s. (“AWT”) disputed the prices for using the Czech railroad system as determined by the Správa železniční dopravní cesty (SŽDC – the Railroad Management Agency) in the so-called “Railroad Declaration”. Although the Declaration should not be altered while valid, the Railroad Management Agency did so in conflict with the law.

Both the Railway Authority and, subsequently, the Ministry of Transportation, to which the Railroad Management Agency appealed, upheld AWT’s claim in January 2013. Both authorities found the objections raised by AWT to be legitimate and declared the Railroad Management Agency’s course of action incorrect.

The results of the proceedings helped AWT save tens of millions of Czech crowns in railroad fees.
