Penalty Rescinded for KŠB Client21/09/15 / News
KŠB helped a client win a lawsuit against the Czech Environmental Inspectorate, which had imposed a penalty on the client, an electric device manufacturer, for failure to abide by the Electric Waste Act. The penalty, which the Ministry of Environment confirmed, was rescinded by the Municipal Court in Prague due to being unlawful.
The dispute dates back to 2005/2006 when there were a number of administrative proceedings in which one funds manager was appointed for each of the ten electrical and electronic equipment (EEE) categories from among the collective systems for electric waste collection. KŠB represented one of the unsuccessful candidates. As a result of winning the dispute, the Ministry of Environment’s selection of the funds manager was abolished. At the same time, all penalties imposed on manufacturers involved in the collection system were not selected for the particular group of devices by the Ministry. Subsequently, the law applicable to the issue was amended and the monopoly eliminated.
